Kidney Pain

I have one kidney(left side) since age 5, today I am 36. Last year I was involved in an automobile accident (rear-ended by a tow truck at 40 mph). Ever since then I have severe to moderate kidney pain. The lower left flank is also sensitive to touch. Three times during the 12 month period I consulted a nephrologist and had urine, blood and CT-scans/ultrasound tests. The findings are:
1. The kidney functions normally.
2. It is enlarged because of the fact that it is compenstating for the missing kidney
3. There was a 5 mm cyst that no longer shows up on a renal ultrasound. The cyst may or may not have been caused by the impact.



Even after 1 year, the pain still remains. I strongly feel that during the high speed impact, an already sensitive and enlarged kidney was traumatised. As a result of which there is enduring pain but not a functional impairment.

My question is this: What is the medical terminology to describe this condition?

I am seeking grounds for litigation and the nephrologist does not want to get dragged into the legal process and therefore is not very helpful.
